| 摘 要： | 我国《婚姻法》新确定了探视权 ,因而从理论上正确认识和在实践中正确行使探视权无疑是执行《婚姻法》的新问题。文章论述了确立探视权的理论价值和实践中的积极效应 ,并从探视权的主体、行使探视权的方式、探视权的限制和探视权的强制执行四个方面就探视权的适用提出了自己的看法和见解 ,说明了适用探视权在司法实践中应注意的若干问题

| Abstract: | The visiting right is prescribed i n the marriage law. How to master it in theory and adopt it in practice is very important to implementing the marriage law. The writing fully discusses the theo retical value and practical effect of the visiting right, puts forward the autho r's views on the practice of the visiting right from the four perspectives of th e main body, the practice method, the limits and the compulsory execution, of th e right, and clearly states how to adopt the visiting right in its practice. |
