| 摘 要： | 美国法学界对中国传统法律文化的研究由来已久,而本文则将关注点集中于美国法学学者21世纪以来在法学期刊以"中国"为关键词发表的中国传统法律文化研究成果。作者发现,美国法学界对中国传统法的研究在新世纪展现出了新的特色,虽然在方法上依然将西方法学理论作为分析中国法律文化的理论依据,但固有的西方中心观的研究视角在不断弱化,突出表现在更为深入地剖析了"法治"原则的西方局限性,并试图从中国传统法律的视角分析与论证"法治"等问题。这也提示我们,中西之间的法律文化交流并不是单向的,双向交流的重要性与迫切性愈发凸显。

| Abstract: | American jurists have a comparatively long history of studying traditional Chinese legal culture. This paper focuses on the China - titled articles published by American Jurists in various law journals since the beginning of the 21 st century. It is found that the study of traditional Chinese legal culture in America has revealed certain new characteristics in the new era. Methodologically, though American jurists still apply Western legal theories to analyze the Chinese legal culture, the dominance of Western- centered cultural value in legal studies has tindergone gradual lessening. A typical example is that American jurists tend to hold that rule of law is mainly an idea of the West and yet some elements of rule of law can be found in traditional Chinese legal culture. Therefore, Sino - Western legal cultural exchanges are by no means unidirectional; nevertheless, bilateral exchanges and communica- tion between the two are of even greater importance and urgency. |
