| 摘 要： | 我国于2005年3月颁布的《著作权集体管理条例》，对我国著作权集体管理组织的设置模式作出了规定：即在各领域只有一家拥有相对垄断地位的著作权集体管理组织。关于著作权集体管理组织的设置模式问题，《著作权集体管理条例》出台前国内外颇有争论，而我国最终采取这一模式是有其现实依据的。采取这一模式也带来一些相关问题，本文就著作权集体管理组织的统一管理机制问题和避免或限制其垄断地位带来的负面问题作了一定的探讨。

| Abstract: | China issued the Copyright Collective Management Regulations in March, 2005. The mode for organizing Chi na copyright collective management provides that： in all fields, only one has a relative monopoly copyright collective management organization. In terms of setting the mode of copyright collective management organization, before the intro duction of the ＂Collective Management of Copyright Ordinance＂, there is quite a controversy at home and abroad, and our final to take this model is based on the reality. Taking this model has also brought a number of related issues, this paper discusses the unified management mechanism of the copyright collective management organization, and tries to a void or limit the negative problems eaused by its monopoly. |
