| 摘 要： | 虚拟财产是伴随着网络信息技术的发展而出现的具有客观性、依附性和虚拟性的新事物,其法律性质和法律地位应当由法律加以确认。在尚无法律规定的情况下,不能认为虚拟财产属于刑法所保护的财产,侵犯虚拟财产的行为不能构成侵犯财产罪。我们应尽量选择保护虚拟财产的非刑法路径,在能够采用其他手段充分抑止侵害虚拟财产的行为时,就不要将该种行为作为犯罪处理。

| Abstract: | Virtual property,which is objective and dependent,is a new thing whose appearance is accompanied by the development of network of information technology.Virtual property's legal nature and legal status should be recognized by law.Because of the absence of legal provisions,it can not be considered that virtual property is protected by the criminal law,and violations of virtual property can not constitute property crime.We should try to choose paths of non-criminal law to protect virtual property. |
