摘    要:商标淡化理论随着商标表彰性功能的崛起而崛起,它以广义的显性和广义的混淆理论(联想理论)为基础,将商标权和保护对象从识别性的保护扩及识别性和表彰性的保护,将商标权的保护领域从同类商品或服务扩及到不相类似的商品或服务,甚至扩及商品或服务之外的其他领域。较之传统的混淆理论和无谓竞争理论,商标淡化理论为驰名商标的保护提供了更为完善的理论基础。

Abstract:The theory of trademark dilution rises with the rise of the commending function of trademark. Baaed on significance in broad sense and theory of confusion(theory of association)in broad sence, it extends the protecting object of trademark right from the protection of discerning character to the protection of discerning character and commending character, it extends the field of protection from similar commodities and services to dissimilar ones and even to other fields beyond commodity and service. As compared with traditional theory of confusion and theory of pointless competition, theory of trademark dilution provides a much more perfect theoretical basis for the protection of famous trademarks.
