| 摘 要： | 围绕党的十六大提出的“到2010年形成中国特色社会主义法律体系”的目标，根据当前中国社会转型期所凸显的特点，针对转型期变动和多元重组的社会状态，运用马克思主义唯物辩证法和法理学理论，论证社会转型期法的调控作用。认为，在社会转型期迫切需要法的调控作用；法必须跳出传统历史的旧框架，主动接受世界先进法学思想和成果；在法的实体上、程序上要不断发展创新，最大限度地适应社会多样化和社会主义市场经济体制的需求，显示法调控作用的社会至上性和彻底性，推动、促进党和国家社会转型期预期目标的实现。

Regulation role of the law in turning period of the society |

| Abstract: | Revolving around the aim of forming socialist law system with Chinese speciality by 2010 put forward in the Sixteenth Conference of People's Represents of CPC, according to prominent characteristics in the turning period of current Chinese society, aiming to society state of the change and multi-element reorganization in the turning period, the author applies maxism's material dialectics and law theory to testify regulation of the law in turning period. The author considers that regulation role of the law is urgently needed in the turning period. The law must grow out of the old traditional framework, absorb actively advanced law ideology and fruit in the world, develop the content and procedure of the law continuously, adapt utmostly the demand of social diversities and socialist market economy system so as to reveal highness and thoroughness of the regulation role of the law and meanwhile to promote realization of anticipating aim in the turning period of the Party and society. |
