| 摘 要： | 死刑是刑罚中最严酷的刑种,颇受中外刑法学者的关注,有关死刑存废之争也尤为激烈.我国1997刑法规定了大量的死刑罪名,很多死刑罪名既有失公正性又缺乏效益性,限制死刑已刻不容缓.鉴于此,本文通过论述死刑存在的合理性以及死刑的实质性及形式性限制措施,并从强化死刑的角度来论证我国死刑制度的限制.
