| 摘 要： | 章试图从国家的制度设计与人性的关系角度论述制度中的人性维度,从抽象的人性论下的国家观到制度设计,清理了历史上的各样人性论观点,并对古典契约论和新契约论,以及反契约论作出合人性的评价。章着重论述了在我国设计出怎样符合人性的国家制度以体现政治制度作为最高的善的价值,并阐发了“以法治国”和“以德治国”以及“德法兼治”的重要性,指出以德治国的现实的必要性和合理性,同时强调指出：必须把法治放在第一位,德治放在第二位。既有“两手”,又有重中之重。

| Abstract: | The paper attempts to discuss how to design the state system which is in accordance with humanity so to embody value of the political system as the supreme virtue. And it explains the importance of "ruling the state with law" and "ruling the state with virtue" and "ruling the state with the laws and virtues. |
