| 摘 要： | 社会学中的场域理论为研究刑事证据提供了新视角和理论工具。对刑事证据进行社会学的研究,就是从关系的角度即群体的内在结构和内在关系来思考个体的特性,由此形成了刑事证据场域。＂刑事证据场域＂是由刑事证据及证明活动所引发的社会利益关系网络＂场＂以及刑事证明的环节、程序和规则所限定的＂域＂,再加上相关主体的＂惯习＂这一主观的性情倾向系统构成,包括场域的主体、时间、空间、资本、程序和惯习六要素。

| Abstract: | The theory of field and boundary in social science has provided new prospective and theoretic instrument for the examination of criminal evidence.The examination of criminal evidences with sociological knowledge is to consider the individual characteristics from the perspective of relationship,i.e.the inner structure and relationship within a collective,so as to form the field and boundaries of the criminal evidences.The ＂criminal evidence field and boundary＂ consists of the ＂field＂ of social interest relation network caused by criminal evidences and proving procedures,the ＂boundary＂ restricted by the criminal evidence proving procedures,programs and rules,and the ＂habitus＂ of relevant principals in their subjective temperament inclination system,including the principals,time,space,capital,program and habitus of the field and boundary. |
