| 摘 要： | “法律与文学”运动是20世纪70年代滥觞于美国继而在中国兴起的一种学术运动，“文学中的法律”是“法律与文学”运动最重要的分支。“文学中的法律”以文学文本作为样本或者平台来探究其中所蕴含的法律问题，这就在研究者与社会现实之间设置了一个“媒介”（文学作品），“发现作品”和“解读作品”就成为研究者必经的两个环节。“文学中的法律”的研究对弘扬法的价值、普及法的知识、改进法学教学、加强法律修辞具有积极的作用。
