| 摘 要： | 我国《合同法》规定了建设工程款优先受偿权，但对于它和抵押权竞合时准更应优先未作规定。本从其给我国经济建设和司法实践造成的问题出发，借鉴国外及我国台湾地区的立法例并采取对比分析之方法，分析了建设工程款优先权更应优先的法理，对我国建设工程款优先权和抵押权竞合时的顺位以及建设工程款优先权的性质、保存方法等方面提出了立法建议。

| Abstract: | Priority right to be repaid on the fund of construction project is stipulated by contract law of our country. But in case it contends against or operate jointly with mortgage rights, there is no stipulation on their sequence of preference, which brings about problems in economic construction and judicial practice of our country. An analysis is made on the legal principle that priority right on the fund of construction project should be more preferred. The analysis is made by using legislative examples from abroad and Taiwan region for reference and by adopting method of comparative analysis. And legislative suggestions are made on such aspects on the sequence of preference in case priority right on the fund of construction project in our country and mortgage rights contend against each other or jointly operate, nature and preservation method of priority right on the fund of construction project. |
