| 摘 要： | 美国司法源于普通法的传统和判例法的实践,其司法官员往往通过判例的选择和区别技术来重构先例和解释制定法;通过对模糊语词的不同理解来表达价值观念;通过迂回的手段和技术性的话语来实现公平正义原则。但公平正义原则的适用并非从判决的字面上就能习得,在某些案例中是需要反复推敲立法者的用意和司法的情境才能清晰辨明的。可通过一个典型案例来分析美国＂公平正义＂原则的司法适用,探析美国司法实质。

| Abstract: | American justice is originated from the tradition of the common law and the practice of the case law.The judiciary in USA usually reconstructs precedents and interprets the statue law with the technology of choosing and distinguishing cases,express their values through various comprehensions on vague terms,and realize the fair and just principle by adopting indirect methods and professional language.However,the application of fair and just principle can’t be displayed in the written judgment.In some cases it becomes clear on the condition that the intention of legislators and the judicial context are fully considered.In order to have a probe into the judicial essence in USA,the paper,based on a specific case,analyzes the application of＂fair and just＂principle in USA. |
