摘    要:教师的教学权利是教师在教学工作中为确保教师能够真正履行其教育教学职责而赋予教师的一项职业权利,它是教师权利中最为基本最为核心的权利。教师的教学权利既表现了教师对自身权力的正当运用,也体现了教师对自身权利的正当要求以及社会对教师权利应享有的制度性安排。由于内部和外部各种复杂又特殊的因素,民办中小学教师的教学权利却得不到真正回归,本文旨在呼唤和维护民办中小学校教师的教学权利,从而推动民办中小学教育和教师自身专业化的发展。

Abstract:Teachers are entitled to plan their teaching at liberty so that they can fulfill their obligation of education. The teaching liberty is a fundamental occupational right. It is justifiable for teachers to demand and exert the rights and for society to entitle teachers to enjoy the rights. However, owing to the plausible and complicate reasons, citizen-managed teachers in primary and secondary schools fail to enjoy the rights adequately. The paper intends to call attention to the protection of citizen-managed teachers' rights. It points out that to promote primary and secondary education and teacher's professional development, it is very important that the teaching liberty should be restored.
