| 摘 要： | 随着行政管理职能的拓宽,行政机关及其工作人员在执行职务的过程中,都可能给公民、组织的合法权益造成损害。对于行政侵权行为,行政相对人有权要求行政侵权主体予以赔偿。但行政赔偿范围的确定,《国家赔偿法》规定的还不够完善,从而损害了行政相对人的合法权益得以救济,亟须调整完善。

| Abstract: | With the expansion of administrative functions,administrative organs and their staff will probably do harm to legitimate rights and interests of the citizens and organizations in the course of performing their duties.For administrative violations,administrative counterparts are entitled to request compensation of the main part of administrative infringement.However,the determination of the scope of executive compensation in the State Compensation Law is still not complete,to the detriment of the relief the legitimate rights and interests of the executive counterpart and urgently needs to be adjusted and optimized. |
