| 摘 要： | 市场经济的核心是竞争，垄断则破坏了竞争机制，作为规制垄断行为，保障市场经济健康运行的反垄断法被称之为“市场经济的基石”，反垄断法的有效实施必须依赖于一个强有力的执法机构。我国在反垄断执法机构的设置模式上应借鉴国外反垄断执法机构设置的经验，同时结合我国反垄断执法的特殊性，打破传统的行政机构的设置模式，建立一个独立的、专业的、权威的．拥有行政权、准立法权、准司法权的反垄断执法机构，以保障我国反垄断法的有效实施。

| Abstract: | While competition is the core of market economy, monopoly can weakens or even destroy such competitive mechanism Anti-monopoly law is considered as the cornerstone to regulate monopolistic behaviors and safeguard the healthy operation of market economy The efficient implementation of anti-monopoly law is dependent on a powerful law enforcement organs In order to safeguard the efficient implementation of China Anti-monopoly Law, our country should use the experience of foreign countries for reference and take it into consideration of the special features of our country's implementation of the anti-monopoly law in selecting the setup mode of the organ to establish an independent, specialized and authoritative enforcement organ with administrative, quasi-legislative and quasi-judicial power |
