| 摘 要： | 宽严相济的刑事政策是我国在维护社会治安的长期实践中形成的基本刑事政策,其实质就是对刑事犯罪区别对待,做到既要有力打击和震慑犯罪,维护法制的严肃性,又要尽可能减少社会对抗,化消极因素为积极因素,做到既严厉打击严重刑事犯罪,又减少社会对抗,增加社会和谐因素,维护社会的和谐稳定。

| Abstract: | Policy of temper justice with mercy means treat crime with lenient and strict enforcement appropriately,at the same time,the judge must control the degree of lenient and strict enforcement when deal with the cases.In the application process of the criminal policy of temper justice with mercy,we should combine leniency with severity and have difference treatment in different time,under different situation,and in different place.The policy,believed to be the essential criminal policy under guideline of comprehensive treatment of social security.The essence is to be given different treatment in different criminal offenses.The one purpose of policy is to deterrent and frighten crime powerfully,maintain the solemnity of legal system,must as far as possible reduce social resistance,and turn the negative factor into the positive factor.Another purpose of policy is to crack down on the serious criminal offense severely,reduce social resistance,increase the social harmonious factor,and maintain society in harmony and stable condition. |
