| 摘 要： | 法人犯罪是市场经济发展的衍生物。在近年来的刑事立法、刑法理论和司法实践中，对法人犯罪问题存在着不同程度的争议。应当说，法人犯罪本身是能够成立的；法人具有独立的人格并能为独立的意思表示，所以法人应当被视为刑法上的犯罪主体；此外，应该认定法人具有特定的权利能力和行为能力，进而正确判断法人的刑事责任能力。
