| 摘 要： | 中药新配方在原中药专利配方基础上进行的药味、剂量加减是否具有创造性的认定异常困难，这不但使司法实践中的侵权认定模棱两可，而且使新配方的专利申报困难重重。在医疗实践中，对原中药专利配方进行的药味、剂量加减，如果能够在作用部位、显著提高疗效、减少毒副作用、适应新的病症等任何一项有所突破，就可以认定该配方对中药领域的普通技术人员来说具有“非显而易见性”，有突出的实质性特点和显著的进步，具有创造性。

| Abstract: | It is extraordinarily difficult to recognize the creativeness of the new traditional Chinese medicine formulas with the addition or subtraction about dosag or medicine that is based on original traditional Chinese medicine formulas. Not only does it make the recognization of tort ambiguous in the legal practice but also the patent declare on the new formulas becomes more difficult. In the medical practice, the additions or subtractions based on patent formulas in drug or dosage should admit the creativeness of theirs if they have some breakthroughs in effect locations, notable improving curative effects, cutting down the poisonous side effects, or adapting to the new illness. So we can say the new formulas possess of ＂not noticeable＂ towards average technicians in traditional Chinese medicine field, have dramatically substantial characteristic and notable progress, and own creativeness. |
