| 摘 要： | 基于内容分析法,探索共享经济背景下专利技术共享的相关实践模式,分析各种模式的特点,结合专利技术的特性提出专利技术共享的未来发展方向。研究发现,专利技术共享的实质是将专利技术的使用权以一定的方式和条件向特定或不特定的人公开。共享经济大潮催生了众多专利技术共享模式,这些模式在一定程度上为创新主体实施专利技术带来了便利。而建立在互联网基础上的专利开放许可能在专利制度与共享理念之间取得平衡,并真正推动创新技术的产业化应用。因此,专利开放许可有望成为专利技术共享的未来发展方向,应加快推动我国专利开放许可的步伐。

| Abstract: | Based on the content analysis method, this paper explores the relevant practice modes of patent technology sharing under the background of sharing economy, analyzes the characteristics of various modes, and puts forward the future development direction of patent technology sharing according to the characteristics of patent technology. It is found that the essence of patent technology sharing is to disclose the right to use patent technology to specific or non-specific people in a certain way and conditions. The tide of sharing economy has spawned many patent technology sharing modes which bring convenience for innovation subjects to implement patent technology. Meanwhile, the Licenses of Right(LOR) based on the internet can strike a balance between the patent system and the sharing concept, and really promote the industrialization of innovative technology. Therefore, LOR is expected to be the future development direction of patent technology sharing, and we should accelerate the development pace of LOR in China. |
