| 摘 要： | 刑事诉讼法二次修正草案关于亲属拒证权的规定,意味着我国强制出庭制度条款将不再适用于被告人的配偶、父母、子女。亲属拒证权规定不仅是对中华传统法文化的继承,也是对西方相关法律的借鉴,反映了现代刑事诉讼理念的基本要求,体现了惩罚犯罪与保护人权相兼顾的精神,标志着我国证据制度正在接近国际公约所规定的标准。

| Abstract: | Relatives of the second draft amendments to the Criminal Procedure law on the right to refuse to permit requirements,means that chinese system of mandatory provisions will no longer appear in court for the defendant’s spouse,parents and children.It both draw on the results of Western laws,but also the essence of Chinese legal culture inheritance.It reflects the modern concept of the basic requirements of criminal procedure,and shows the spiritual of crime punishment and protection of human rights.It indicates that Chinese evidence system is close to the international standards under the Convention. |
