| 摘 要： | 我国统一合同法引入了债权人代位权制度,最高法院的司法解释又对代位权的行使作了进一步的明确,但对于代位权的行使效力问题争议颇大。如果从代位权行使的效果归属、对当事人的效力和既判力范围等几个方面对代位权的行使效力进行分析,直接受偿制度在我国的确立具有重要的理论和现实意义。
