| 摘 要： | 综合运用了比较分析方法、历史考察方法、价值分析方法、系统论方法等法学方法依次阐明对流质契约的一般分析,检讨我国流质契约禁止主义说的主要观点,论证解禁流质契约的科学合理性,探讨我国流质契约制度重构的路径选择,以期对发展和完善《物权法》以及对我国民法典的制定有所裨益。

| Abstract: | The liquidity contract refers to the contract engaged by the civil subjects in the contract of surety-ship,which the secured creditor will attain the ownership of the engaged collateral when the debtor can't pay off the due debt.The contract is prohibited definitely by the security legislation in most countries in the world,wherein it is also denied by civil law academic circles in China.This paper used the method of comparative analysis,historical study,value analysis,system theory and law means in turn sets out the general analysis of the liquid contracts,review of China's liquidity contract,the main points against liquidity contract,the scientific reasonability of liquidity contract to explore the path selection of China's fluidity contract system reconstruction,with a view to develop and improve the "Property Law" as well as benefit the development of China's Civil Code. |
