| 摘 要： | 王志祥博士在《法制日报》上发表论文专门为犯罪既遂“构成要件说”进行辩解。但笔者认为,在犯罪既遂的判定标准上,“构成要件说”与犯罪构成理论自身相矛盾、与刑法第20条的规定相矛盾、与汉语词典对“遂”字的解释相矛盾、与犯罪人的心理状态相矛盾,这就使它在理论上难以自圆其说。至于王博士所说的不同的犯罪停止形态具有不同的修正的犯罪构成的观点、脱离犯罪构成后就不能正确认定犯罪的停止形态的观点、区分犯罪停止形态属于定罪活动的应有内容的观点,以及犯罪构成符合性评价与犯罪形态符合性评价同一的观点,都是难以成立的。简言之,“构成要件说”关于犯罪既遂的判定标准不具有合理性。

| Abstract: | There is an article in Legal Daily by Dr.Wang Zhi-xiang in which he tries to defend constitution factors of crime accomplishment.However, the author of this article holds the opinion that with the criteria of crime accomplishment,it is contradictionary with criminal constitution theory,with Item 20 in criminal law,with explanation of "accomplishment" in Chinese dictionary,and with mentality of the criminal.In short,"constitution factors" is irrational as criteria to judge crime accomplishment. |
