| 摘 要： | 伦理和法律制度作为两种不同的社会控制模式，在实践中需要相互支撑，伦理与法制制度自身的特点和社会的现代转型，使伦理的制度化成为必要和可能，同时也决定了伦理制度化的基本界限。伦理的制度化、法律化必须限制在一定的范围内，过分的制度化，既会侵损道德，亦将消解法律与制度。
