| 摘 要： | 随着信息技术的发展,著作权限制出现双向强化的发展态势:一方面,法定许可结合著作权集体管理的制度将代替授权许可,成为网络环境中作品授权使用的主渠道,这增强了对著作权的限制。另一方面,合理使用向法定许可转化,强化了对公共利益的制约。网络著作权的限制还呈现出一种内化和弹性化的趋势,以默示许可和创作共用许可为典型。

| Abstract: | With the development of information technology,the copyright restriction shows the trend of bidirectional enhancement.On the one hand,the system of statutory licence and collective copyright management will replace the authorized permission to become the main channel of work authorization.This tendency strengthens the limit to the copyright.On the other hand,the transformation from the fair use to the statutory licence intensifies the limit to the public benefit.The Internet copyright＇s restriction also presents tide of internalization and elastification.The implied license and creative common use are the representative examples. |
