| 摘 要： | 我国司法界应充分理解与把握和谐社会主义的理念，尤其在法院的刑事判决过程必须落实刑法的教育目的，正确适用缓刑制度。我国应以和谐社会主义理论为指导，恰当地适用缓刑制度，从而化解更多的社会矛盾，体现政府人性化管理并真正达到社会更良好运行的状态。

| Abstract: | The judicial circles in China should fully understand and grasp the concept of harmonious socialism,especially in the court decision process of criminal law must implement the education aim and correctly apply probation system.This paper holds that the socialist harmonious theory can be appropriately applied to probation system,resolving social contradictions,and emboding the more humanized management. |
