| 摘 要： | 我国刑法第20条第3款的规定．引起了刑事法学理论界和实务界等方面人士的广泛关注，本文在对主要观点进行评析的基础上，提出了特殊防卫权的立法价值主要表现在：特殊防卫权的设立，体现了对人权的有效保护，体现了对公正价值的有力保证．体现了对预防功能的大力加强．体现了对社会良好秩序的巩固和发展。
