| 摘 要： | 食品安全直接关系到人们的身体健康，而当前的食品安全形势却不容乐观。正确适用食品领域的惩罚性赔偿。让违法者对受害人进行超出实际损害的赔偿，有助于防止违法行为的再次发生。但适用时还存在适用条件有失合理、程序欠妥、赔偿基数有失公平等问题，因而应适当扩大适用条件、创建便利的求偿程序、合理确定赔偿数额和尝试新的求偿机制，以真正实现惩罚性赔偿的法律价值。
