| 摘 要： | 我国《合同法》明确了交易习惯的法律地位，但对交易习惯的概念理解和法律适用未作具体规定。《合同法》上的交易习惯兼指习惯与习惯法，适用于合同条款的解释，合同漏洞的弥补，规范合同行为。交易习惯在《合同法》中的效力主要表现为：补充合同法适用的效力；优先于合同法适用的效力：解释合同标准的效力。

| Abstract: | The legal status of trade usage has been regulated in Laws of Contracts of the People＇s Republic of China, but the definition and the legal application of trade usage haven＇t been definded clearly .Trade usage means not only custom but also customary law, applies to the interpretation of clauses of contract and the remedy of loophole of contract and regulate the act of contract. The legal force of trade usage in Laws of Contracts＇reveuls mainly： to add any complementary part to apply to the conditions of the Laws of Contracts; to be prior to the conditions of the Laws of Contracts ;to interpret the legal force of the criterion of the Laws of Contracts. |
