| 摘 要： | 关于习惯法的概念,不同的学者有不同的理解和认识,但对于习惯法的特征则已基本形成共识,这就是其植根的乡土性、内容的生活性、程序的非正式性、管辖的地域性、运作的内控性和保持的恒定性。习惯法在不同历史时期、不同地域和不同民族群体中的价值和作用是不一样的,在传统的熟人社会里,其价值远大于国家法。在现代社会里,其作用也不能完全否定,在一定区域和特定时期,运用多种社会控制手段实现社会秩序,是降低社会控制成本和构建和谐社会的必然要求。

| Abstract: | Although scholars differ in their understanding of the concept of customary law,its characteristics are generally agreed upon:its root in the countryside;its content of daily life;its informal process;its local jurisdiction;its internal control of operation;and its stability in tradition.The value and function of customary law vary from time,place and people.In the traditional society of familiar acquaintances,customary law may outweigh state law.In the modern world,the value of customary law cannot be negated.Within certain time and places,it is necessary to exercise various social control means to reduce the cost in our efforts to build a harmonious society. |
