| 摘 要： | 本拟对我国刑罚目的的选择作一些探讨。首先对刑罚目的的进行了界定、对相近概念进行了辨析。其次，重新梳理平析了有关学说，为后奠定基础。最后，针对我国刑罚目的的选择的困惑，论证了我国刑罚目的之应然选择是采一体论，并且应当在刑罚适用的不同阶段注重一体化之不同侧面，寻求动态平衡中适宜的刑罚目的。

| Abstract: | The purpose of the punishment is in relation to its formulation and execution, to its order of severity and effect. So in the theory of the crime, it's very important. Since the appearance of the punishment, the choice about its purpose is having been a problem. Many jurists and philosophers have studied carefully about it. So there are different theories, there is conflict between the Retribution and Utility. The article discusses on the purpose of the punishment. At first give a definition of it, then compare with the resemble concepts. Afterwards, comment on the related theories. Lastly, put forward our country should select the punishment and individual prevention to be the purpose of the punishment. |
