| 摘 要： | 我国养老保险基金的良性有序运行事关养老保险制度的成败。但遗憾的是，我国养老保险基金在运行中存在统筹基金与个人账户基金混账管理导致个人账户“空帐运行”；投资收益目标与风险承担能力之间的矛盾突出；养老基金的筹资方法不规范，且缺乏应有的法律支持；养老基金的管理效率低下，监管体制混乱等现实问题和急需解决的法律漏洞。

| Abstract: | Whether the institution of China＇s Annuity can succeed or not depends on the operation of Annuity. But it is a pity that there are several serious practical problems and legal loopholes in the operation of China＇s Annuity, such as the mixed administration of personal fund and the whole fund leading to the 0 operation of personal account, the contradiction between the benefit objectives of investment and the ability to assume the risk, illegal method to collect annuity, low administration efficiency without good supervision. |
