| 摘 要： | 善意取得制度对从事交易的善意第三人来说是权利保护，对原财产所有人或经营人的物上追及权来说则是限制。我国民事立法关于善意取得制度的规范不够系统、严密，只有动产所有权善意取得的零散规定，并未涉及动产质权的善意取得，这方面的理论研究也相对较少。本文着重从要件构成方面详细阐述了动产所有权的善意取得和动产质权的善意取得。

| Abstract: | Innocent purchase system is the protection of the right and benefit of the third party acting in good faith and the limit to the right of resourse of the original owner or the dealer.In China the system of innocent purchase in civil legislation is not systematic,nor strict,for there are only fragmentary stipulations about the innocent purchase of the ownership of free estate(chattels),but there is nothing related to the innocent purchase of chattels mortage.Now few articles provide theoretical research on this aspect.Therefore,this paper probes into the innocent purchases of both the ownership of free estate and the chattels mortage from the composition of the essentials. |
