| 摘 要： | 目的/意义]基于《专利代理条例》强化高价值专利培育导向,以有效举措激励高价值专利产出和转化运用,支撑专利代理机构高质量发展。方法/过程]通过调研分析,指出目前高质量知识产权服务的机构总体偏少,行业规模与机构规模不匹配、市场需求与机构能力不匹配、国内业务与国际业务不匹配、服务本地与服务长三角一体化乃至全国不匹配、面临低价恶性竞争、转化运营困难等问题,进而提出建议与展望。结果/结论]针对以上痛点难点问题,深入调研听取协会、服务机构和创新主体对于专利代理机构现状的意见建议,分析汇总知识产权服务体系建设存在的问题,研究提出整改举措,建议出台政策激励专利代理机构提升服务能级和水平、鼓励专利代理人能力提升、提高专利代理人待遇、整顿专利代理行业不规范问题、充分发挥知识产权行业业协会作用、着力挖掘高价值专利,促进专利代理行业高质量发展,服务科创中心建设。

| Abstract: | Purpose/significance]Based on the patent agency regulations,the paper aims to strengthen the cultivation orientation of high value patents,encourage the output and transformation of high-value patents with effective measures,and support the high quality development of patent agencies.Method/process]Through the investigation and analysis,the paper points out that there are less high quality intellectual property service institutions in general,the industry scale does not match with the organization scale,the market demand does not match with the institutional capacity,the domestic business does not match the international business,the local service does not match the Yangtze River Delta integration and even the whole country,faces the low price vicious competition,the transformation operation difficulty and so on.Then some suggestions and prospects are put forward.Result/conclusion]In view of the above pain points and difficulties,the paper researches opinions and suggestions of associations,service agencies and innovation subjects on the status quo of patent agencies,analyzes the problems existing in the construction of intellectual property service system,and proposes some rectification measures,including introducing policies to encourage patent agencies to improve their service levels,encouraging patent agents to improve their abilities,increasing the treatment of patent agents,rectifying the non-standard problems of patent agency industry,giving full play to the role of intellectual property industry association,focusing on mining high value patents.These measures can promote the high quality development of patent agency industry,and serve the construction of science and technology innovation center. |
