| 摘 要： | 学校体育场馆对外开放已经成为社会关注的热点问题,学校在体育场馆开放后扮演什么样的角色,它与入校锻炼的公众之间又存在怎样的法律关系呢？将学者们的不同观点进行了梳理,在此基础上将二者的法律关系界定为服务合同关系,探索二者之间具体的权利和义务,以期引起法学、司法和体育界的广泛关注和深入探讨。

| Abstract: | The opening of school sports facilities has become a hot issue.After the opening of school sports facilities,what dose school play？ What＇s the legal relationship of school and fitness people？ In this paper,the different viewpoints of scholars are tired.We define the service contracts,and explore their specific rights and obligations to arouse the law,justice and the sports community＇s wide attention and depth discussion. |
