| Abstract: | The originality is the soul of a works. It is also the essence of the copyright law. This paper surveys the ways two systems of copyright protection in the world define the works originality, and analyzes systematically the connotation, features and definition of the work originality. It also suggests improving the standards for defining the works originality in Chinese copyright theory and adopting the right attitude. |
