| 摘 要： | 在介绍外国人事诉讼立法概况的基础上，作者对我国人事诉讼程序的理论研究状况及立法现状进行了梳理和分析，结果表明，理论上的研究不够深入、相关的立法并未与时俱进。学界只是对人事诉讼程序的枝节问题进行了初略探讨，很少有人从宏观的角度对人事诉讼程序制度进行全方位的研究，尤其是对外国颇为完善的人事诉讼理论体系、制度缺乏详实的比较研究。鉴于民事诉讼法与民事实体法的血肉联系，随着相关民事实体法的日益完善，民事诉讼法的有关程序亦有相应完善之必要，以利二者之间的协调。

| Abstract: | This paper analyzes the the theory research of personal procedure and legislative situation in China on the basis of introduction of the legislative reviews of foreign personal procedure.The results show that the study in theory is not deep enough and comprehensive,and the relevant legislation is not keeping pace with the times. |
