| 摘 要： | 《紧急状态法》的立法动议已呼吁多年,但始终未提上立法日程。本文结合政府危机管理的理论与实践,提出了“政治性紧急状态”和“社会管理性紧急状态”的分类,梳理了国际上紧急状态立法形式,探讨了我国《紧急状态法》制定的必要性、可行性及立法选择;《紧急状态法》的基本内容及体系;如何强化政府危机管理职能;危机应对预案的法制化;建立政府危机管理的信息系统以及如何约束紧急状态下的公民义务等问题。

| Abstract: | The legislative suggestion about "Emergency Law" has made for many years, but it has not yet come into the agenda of law-making. This paper discusses the issues of feasibility of promulgation of Emergency Law, the basic content of the Emergency Law, the way to strengthen government function in emergency management, legalization of policies and preparation for emergency, setting up information system of government emergency management and limitation of duties of citizen under the state of emergency. |
