| 摘 要： | 从体育运动参与主体的性质、法定权利、体育侵权的特点、故意与过失要件的把握、学校体育的特殊性等方面,对体育侵权行为的危害后果进行剖析,用民事侵权行为的基本理论阐释其在体育运动中的应用。同时,针对体育运动的特点,探索民法学理论对体育活动的适用性。研究认为,在行为规则的适用效力上,应当按照法律位阶来办,体育活动不能成为法律的真空,法律规定也不能机械地干涉体育的精彩性、娱乐性,特别要注意体育活动在现实生活中的重大影响和作用。从理论上确立体育参与者在体育活动中的法律地位和权利,以及寻求权利保护的方法和途径。

| Abstract: | From the point of nature of sports participation subject,legal right,characteristics of sports tort,intention and negligence judgement,particularity of school sports,this paper made analysis on harmfulness of sports tort,explained the application in sports activity using the basic theory of civil tort.Meanwhile,based on characteristics of sports activity,the author explored the adaptability on sports activity from the civil law theory.The result showed that under the applicable effect of behavioral rule,it should be done according to law.Sports activity cannot be the vacuum of law,and law regulation cannot interfere with wonderful,amusement of sports activity,particularly for major influence in real life.From the theory,it should establish the legal status and right for sports participator,and search for the method and way of right protection. |
