| 摘 要： | 非法证据排除规则体现了刑事诉讼中的实体正义与程序正义之间的冲突,体现了惩罚犯罪与保障人权的冲突,对于其价值选择应该根据我国现状。对于“毒树之果”则不应该排除,它实现了诉讼效益,同时也体现了效益与公正的统一。

| Abstract: | Illegal evidence eliminating principles reflects the conflict between criminal litigation justice of concrete and procedure, it also reflects the criminal punishment and human rights securing. Its value selection should be according to the currency of our country. As for "the fruits of poison tree", should not be eliminated, since it brings out lawsuit efficiency and reflect the combination of efficiency and justice. |
