| 摘 要： | 目前我国缺少完备的民事诉讼生效裁决执行体系,以致一些实体裁决往往无法落实。民事执行中普遍存在的"执行难"、"执行乱"问题严重影响了债权人权利的实现。在此背景下,民事执行权的改革无疑将成为我国司法改革中亟待研究的课题。这就需要从执行权的本质出发,从逻辑上厘清执行权的内在属性,从理论上为我国执行体制改革提供指导和支持。

| Abstract: | The civil execution system is not efficient in China yet,which makes trial cannot be executed.The creditors’ rights are severely influenced by the situation of "execution difficulty","execution arbitrariness".Under this back ground,the reform of the civil execution power is very crucial in our judicial reform,which means we have to make clear of the civil execution’s character logically. |
