| 摘 要： | 我国现行夫妻法定财产制存在严重问题，集中体现在夫妻人身关系的剐体主义与夫妻财产关系的一体主义并行所产生的冲突。建构以分别财产制为基础，吸收共同财产制思想的夫妻法定财产制度是我国婚姻法合理的立法选择。

Ponderation over China's Statutory Marital Property System |

| Abstract: | The weak points of China's present statutory marital property system find expression in the clash between the doctrine of separate conjugal personalities in their personal rights and the doctrine of integrated conjugal personality in property relation. A statutory marital property system with common-law property system as its fondation and the doctrine of community property system as a complement is more suitable for China's Marriage Law. |
