| 摘 要： | 利用先行为人的先行行为实施犯罪的行为应当如何定罪在司法实践中存在争议，无论是抢劫罪、抢夺罪还是盗窃罪都因为构成要件的部分缺失而不能简单适用。从先行为人与后行为人各自行为之间的内在关系来看，如果后行为人对于先行为人的行为抱有“利用”的故意，可以按照间接正犯来处理，否则就只能视其行为要件具体定罪了。
