摘 要: | 我国现有行政决策模式下,公民在行政决策中并无实质性的话语权。以协商民主理论构建新型的行政决策模式是改变这一现状的可能途径。行政协商决策的正当性,可以从决策的前提、过程及结果三个方面进行考察。但是在实践中,行政协商决策可能遇到诸如公共理性不足、参与者实际上的不平等及达成共识困难等问题。为此,有必要建立起多维度的行政协商决策制度保障体系,包括以信息公开与社会组织化为主要内容的基础性制度,赋予公民决策启动权、规范决策过程话语秩序与话语权力的规则制度,以及以司法审查、权力机关监督和行政决策评估等途径的责任追究制度。

Abstract: | In the existing administrative decision-making mode,citizens have no substantive power of discourse.So,using deliberative democracy theory to build a new type of executive decision-making model is the possible ways to change the status quo.The legitimacy of deliberative decision-making of administration could be reviewed from the premise,process and results of decision-making.But in practice,deliberative decision-making of administration may encounter a series of problems.Therefore,it is necessary that the institutional protection should be built from the basic system,the system of rules of deliberative decision-making and responsibility-assigning mechanism. |
