| 摘 要： | 如何确定网络侵权案件的管辖权以平衡国际、国内利益冲突。是世界各国面临的共同问题。在解决网络侵权案件管辖问题的实践探索中，美国、欧盟等国积累了丰富的经验，但随之出现的问题是各国管辖权的扩张。我国在这种国际环境下，应立足中国实际，借鉴他国先进经验，密切与世界其他国家合作。以走出目前网络侵权案件管辖的种种困境。

| Abstract: | How to determine the jurisdiction of internet infringement case to balance international and domestic interest conflicts is a common problem confronting all countries all overthe world.During the practical exploration onthe issue of jurisdiction in the internetinfringement cases,the United States,European Union and other countries have accumulated abundant experiences.Meanwhile,there is an expansion of the jurisdiction amongthe countries,which ignores the interests of other countries and causes the international criticism.In this international environment,Chinashould learn from the advanced experience of other countries basedontherealities,and keepin close cooperation with other countries in the world to walk out of the dilemmaof jurisdiction inthe current internetinfringement cases. |
