| 摘 要： | 遗失物拾得制度的核心是返还遗失物。赋予拾得人报酬请求权不仅平衡了拾得人和遗失人之间的权利义务,而且还会有效地激励拾得人的返还热情,有利于保护遗失人的权利。我国法律应赋予拾得人报酬请求权,应规定报酬请求权的种类、报酬数额,并明确规定拾得人不享有同时履行抗辩权和留置权。
