| 摘 要： | 从职业体育俱乐部的权利义务、职业体育俱乐部的外部关系、职业体育俱乐部的机构设置和民主决策三个方面讨论了职业体育俱乐部管理上的法律问题。作为企业的职业体育俱乐部其基本权利为企业法人财产权；其特殊权利是指俱乐部依法所享有的各项优惠权利。职业体育俱乐部的外部关系包括：俱乐部与政府、协会及其他俱乐部之间的关系。我国职业体育俱乐部的机构设置尚未形成现代公司制的法人治理结构，因此其内部监督机制和民主决策方面都存在问题。

| Abstract: | Law issues about management of professional sports clubs are discussed as following aspects:rights and obligations;outer relations;organization setup and democracy decision making of clubs.As an enterprise the basic right of clubs is property right of corporation and its special rights are all kinds of favorable rights held according to law.The outer relations of professional sports clubs includes the relation between clubs with government and associations with other clubs.At present organization setup of the Chinese professional sports clubs haven't been provided with management organization of modern corporation,so there may exist some problems on inner supervision mechanism and democracy decision making. |
