| 摘 要： | 学校体育场馆开放后,学生在校园里发生人身伤害事故,法律责任如何划分,这是开放的学校最为担忧的问题。本文在明确第三人侵权的构成要件,分析学校体育场馆开放后学校对学生的安全保障义务基础上,指出在第三人侵权的情况下,学校如果有过错,应当承担补充赔偿责任。

| Abstract: | When the students on campus commit injury accidents after the opening of school sports venues,it has been the most worrying thing for schools which open those sports venues to divide legal responsibility.This article,on the basis of making clear the constituents of the third infringement and analyzing the the safety obligations for students after opening to public,points out that,under the situation of the third infringement,the school shall bear the additional liability if the school has fault. |
