| 摘 要： | 惩罚性赔偿数额的确定是惩罚性赔偿制度理论中引起争议最多的问题,也是将惩罚性赔偿制度引入我国立法后在司法实践中可操作性较强的问题。文章就我国现行惩罚性赔偿数额的规定进行分析思考,指出其不足。介绍了英美法系国家的相关规定,提出完善我国惩罚性赔偿数额的几点立法建议。

| Abstract: | There is an intense discussion on how to determine the sum of compensation for the punitive damages.It is also a practical problem in judicatory after it is brought into the law.This article analyzes the present system of the punitive damages in our country and points out some imperfection.Then it introduces the punitive damages of Anglo-American Legal System,and puts forward some lawmaking suggestion. |
