| 摘 要： | 由于抵押物权具有价值性以及具备代位性等特点,为平衡抵押关系各方利益,保障交易秩序,抵押权的追及力应发生变异。在原物转让的情形下,对原物的追及力灭失,而对由此所获得的新物(价金)继续享有抵押权。即抵押权的追及力变异为代位性。

| Abstract: | As mortgage rights have the attributes of value and subrogation, the recourse of these rights may undergo dint variation to balance the benefits of the parties concerned in a smooth and orderly trade. In the case of the original property having being transferred, the recourse right to the original property is lost but the new property gained from the transfer still bears the mortgage rights. Thus, the recourse of the mortgage rights is realized in subrogation. |
